Petit test
Guess first, no penalty. The UK judiciary's guidance on AI says information you type into a public AI chatbot (an AI chat tool anyone can use online) should be treated how?
Confidentiality means keeping client information private. Privilege is the legal protection that keeps some lawyer and client communications from being disclosed. Both can be put at risk by one paste into the wrong tool.
What the guidance says
- The UK judiciary's AI guidance says anything typed into a public AI chatbot "should be seen as being published to all the world".
- The SRA (the regulator for solicitors in England and Wales) lists as a risk "a staff member using an online AI, such as ChatGPT, to answer a question on a client's case" (Risk Outlook, November 2023).
- In the US, ABA Formal Opinion 512 (July 2024) says that for self-learning tools, "a client's informed consent is required" before client information goes in.
So client material goes only into tools your firm approved for it. Everything else gets roles and placeholders.
A prompt is the message you send to the AI. This one gets drafting help without client details:
Draft a short letter asking a client for their signed lease and the
last six months of rent receipts, needed by [date]. Use [client name]
and [address] as placeholders. Don't add anything else.
